Overview

Welcome to A&A Equipment Pty Ltd! This Terms of Service includes all related information, content, features, tools, products, and services to provide you, the Customer.

 

These Terms of Service apply to all sales and service by A&A Equipment Pty Ltd and to its customers unless they are specifically varied in writing.  These conditions cannot be construed to apply to purchases made by A&A Equipment Pty Ltd.

 

By agreeing to these Terms of Service, you represent and warrant that all the information you provide in our business is correct, current and complete and that you have all rights necessary to provide this information.

 

Definitions

Definitions shall have the following meanings:

  • A&A Equipment Pty Ltd – “we, “us” and “our” refer to A&A Equipment Pty Ltd
  • Customer/s – person/s, firm, or company from whom the order was received or its legal assigns or successors
  • Products and/or goods – those items specified in the order accepted by A&A Equipment Pty Ltd

 

Terms of Payment

A&A Equipment Pty Ltd accepts the following terms of payment for both Sales and Service of goods/items:

 

COD, EFTPOS/Credit Card, * Direct Credit Bank Transfer (payment in full)

* copy of remittance advice/bank transfer must be emailed or presented to A&A Equipment Pty Ltd before goods/items will be released to the customer * (Not applicable to customers on a pre-approved 30 day account agreement)

 

Purchase Orders

Purchase orders placed by any person, or firm or company through its employees, whether in writing or verbally, are deemed to incorporate these Terms of Service.

 

Customer Supplied Product

We do not accept any liability for the quality or accuracy of any customer supplied product or specifications.

 

Conditions of Repair/Warranty Claims

Warranty claims are subject to assessment and approval by A&A Equipment Pty Ltd. The Customer is responsible for risk to the goods whilst being delivered/freighted to us.

 

Quote Fee

Will apply to any machine assessed and not repaired.

 

Storage

Unless otherwise agreed, goods are to be dispatched or collected within 14 days of o equipment repair/service completion or purchase. Storage fees are applicable if goods remain in our warehouse past 14 days, storage fees are charged at $50.00 per week and are payable before the release of goods/items in accordance with the Uncollected Goods Act 1995.  Any goods not collected within three (3) months of the date of completion can be sold by the repairer and the proceeds of the sale applied to the repairer’s fee, the cost of parts and materials supplied, storage costs, insuring goods whilst on the premises and any other expenses incurred by the repairer incidental to carrying out the repair.

 

Cancellation and Returns of Sales Orders

Where we agree at the Customer’s request to cancel an order prior to delivering the goods to the Customer, we reserve the right to charge for all costs incurred prior to the cancellation and to charge a cancellation fee of up to 25% of the price of the goods to cover overheads associated with the order. The Customer’s request must be in writing and prior to the delivery of the goods.

 

All goods must be un-used and in new condition. A 35% restocking fee will be charged for all returns due to change of mind (does not include any or all freight). Return freight is the customers responsibility.

 

Prices and Charges

Unless otherwise expressly stated by us in writing, all goods will be charged at prices ruling on the date the purchase order is accepted and are subject to Goods and Services Tax (GST).

 

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges where applicable.

 

In addition to the purchase price, all delivery charges, sales tax, GST, extra packaging charges and Government taxes, if any, shall be payable by the Customer.

 

You represent and warrant that the credit card information you provide is true, correct, and complete, you are duly authorised to use such credit card for the purchase, charges incurred by you will be honoured by your credit card company, and you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

 

Tolerance

Unless expressly agreed to the contrary, the provisions and tolerance contained in the standard to which goods are repaired, serviced, or sold by us or its suppliers will apply to all orders.

 

Risk

The responsibility for loss or damage of goods shall pass to the Customer upon delivery to the Customer, the Customers agent or to a destination nominated by the Customer or to a carrier nominated by the Customer.

 

Deliveries and Lead Times

Deliveries may be suspended by us in the event of any strike, lockout, trade dispute, fire, tempest, breakdown, riot, theft, crime, civil disturbance, war or legislation. The inability of A&A Equipment Pty Ltd to procure goods due to any of the foregoing causes or any other occurrences preventing or retarding performance of the contract of delivery of goods – no responsibility shall be attached to us for any delay, default, loss or damage due to any of the above causes, or to any cause beyond the control of A&A Equipment Pty Ltd.

 

Delivery lead time quoted is calculated in working days excluding weekends, Public Holidays and office closures.  It is also subject to any third party supplier lead times and deliveries.

 

Property

Property of the goods shall remain with us until such time as full payment is received. If payment is not received, or if we believe that the Customer may fail to pay for the goods when payment is due, we may re-take possession of the goods still in the control of the Customer.

 

Retention of Title

Irrespective of any payment arrangement between us and the Customer, unless agreed to in writing by the Managing Director, or authorised Manager, of A&A Equipment Pty Ltd the provisions of this term (retention of title), shall from time to time on the following:

  • Property in the goods sold by A&A Equipment Pty Ltd will pass on to the Customer only after the goods have been paid for in full
  • Goods supplied by A&A Equipment Pty Ltd will be at the Customers risk upon dispatch
